1. Introduction

These Website Terms of Use govern access to and use of the Eshe informational website.

These Terms apply only to the Eshe website. They do not govern the use of the Eshe mobile application, AI features, calendar, cycle tracking, mini check-ups, community / forum, subscriptions, payments, or any other app-based features.

Use of the Eshe mobile application is governed by separate documents:

• Eshe App Privacy Policy;

• Eshe App Terms of Use.

By using the Eshe website, the user must comply with these Terms to the extent they apply to the use of the website. If the user does not agree with these Terms, the user should stop using the website.

2. Who Operates the Website

Unless expressly stated otherwise in a separate document or local notice, the Eshe website is operated by:

3. Purpose of the Website

The Eshe website is an informational resource. It may contain information about Eshe, the mobile application, the project’s mission, product features, partners, news, articles, educational materials, events, team, collaboration opportunities, and ways to contact Eshe.

Through the website, the user cannot:

• create an app account;

• use the AI assistant;

• maintain a calendar or cycle tracker;

• record symptoms;

• upload health-related files;

• use mini check-ups;

• participate in the community / forum;

• purchase an in-app subscription, unless such functionality is separately provided on the website;

• use the main digital features of the Eshe mobile application.

If the user moves from the website to the mobile application, App Store, Google Play, or another external resource, further use of the relevant service is governed by the separate terms of that service, application, or platform.

4. Descriptions of App Features on the Website

The Eshe website may contain descriptions of mobile application features, AI assistants, trackers, calendar, educational materials, partner opportunities, paid features, marketplace, community, programs, or other Eshe product areas.

Such descriptions are provided for informational and introductory purposes. They do not guarantee that any particular feature, scenario, program, price, paid functionality, partner offer, or integration will be available to every user, in every country, on every device, in every app version, or for an unlimited period of time.

The actual scope of features, availability, limitations, languages, countries, platforms, prices, subscriptions, technical requirements, and terms of use of the mobile application are determined by the current version of the application, the Eshe App Terms of Use, the Eshe App Privacy Policy, App Store / Google Play rules, and other applicable terms.

Eshe may change, update, limit, replace, combine, temporarily suspend, or discontinue certain features, materials, partner scenarios, or descriptions on the website due to product development, technical, legal, commercial, or operational reasons.

5. Website Information Is Not an Offer

Information published on the Eshe website is not a public offer, a guarantee that a contract will be concluded, a guarantee that a service will be provided, or a guarantee of the availability of the application, any specific feature, price, partner program, commercial term, or result, unless Eshe expressly states otherwise.

Any descriptions of the product, partnerships, programs, offers, collaboration opportunities, development plans, events, features, or commercial terms on the website are provided for informational purposes and may change.

If Eshe publishes a separate offer, competition, partner program, promotion, campaign, or other initiative on the website, additional terms, limitations, validity periods, eligibility criteria, and rules of the relevant program may apply.

The user should not delay seeking professional medical help, change treatment, stop taking medication, change dosage, or make medically significant decisions based only on information published on the Eshe website.

7. Website Informational Content

Eshe seeks to provide high-quality and useful information. However, website content may be incomplete, outdated, changed, inaccurate, or not applicable to the user’s specific situation.

To the extent permitted by applicable law, Eshe does not guarantee:

However, use of the Eshe mobile application, account creation, access to paid features, AI features, community, material uploads, or other app-based services may be subject to age restrictions described in the Eshe App Terms of Use and the Eshe App Privacy Policy.

If the user has not reached the age required to use the application or certain Eshe features, the user should not use such features without an appropriate legal basis, consent of a parent / legal guardian, or other requirement where required by applicable law and Eshe’s documents.

9. Links to the App, App Store, and Google Play

The Eshe website may contain links to the Eshe mobile application, App Store, Google Play, or other application download platforms.

Following such links may direct the user to a third-party resource operated by the relevant platform or provider.

Use of App Store, Google Play, or another platform is governed by the terms and policies of the relevant third party. Eshe does not fully control the rules, availability, technical operation, payment processes, refunds, ratings, reviews, or decisions of such platforms.

The presence of a link to the application does not guarantee that the application or any specific features are available in the user’s country, on the user’s device, in the user’s language, app version, operating system, or account type.

Use of the Eshe mobile application after installation is governed by the separate Eshe App Terms of Use and Eshe App Privacy Policy.

10. External Links and Third-Party Resources

The Eshe website may contain links to third-party websites, social networks, partner pages, articles, videos, forms, payment pages, app stores, or other external resources.

If the user follows an external link, the user leaves the Eshe website. Use of a third-party resource is governed by the terms, privacy policies, and cookie policies of the relevant third party.

The presence of a link to a third-party resource does not mean that Eshe endorses, controls, verifies, or guarantees that resource, its content, security, availability, accuracy, services, products, offers, or data processing practices, unless Eshe expressly states otherwise.

To the extent permitted by applicable law, Eshe is not responsible for the content, security, availability, accuracy, actions, privacy policies, or data processing practices of third-party resources that are outside Eshe’s reasonable control.

Unless Eshe expressly states otherwise, the user does not acquire ownership rights to the website, brand, materials, content, design, or other website elements.

This section does not limit Eshe’s liability for breach of mandatory obligations relating to personal data protection, security, consumer rights, or other mandatory obligations to the extent such liability cannot be excluded or limited under applicable law.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for intentional misconduct, gross negligence, fraud, harm to life or health, breach of mandatory consumer rights, or other cases where limitation of liability is not permitted.

If Eshe does not specify another main version, the English version of these Terms prevails.
