Terms of Use

1. Introduction

These Terms of Use govern access to and use of the Eshe service, including the mobile application, website, digital interfaces, AI features, calendar, tracking features, mini check-ups, content sections, comments, community / forum features, paid features, subscriptions, and other related Eshe services.

By using Eshe, creating an account, signing in to the application, viewing content, interacting with the AI assistant, publishing user content, purchasing a subscription, or using any other Eshe features, the user agrees to comply with these Terms.

If the user does not agree with these Terms, the user must not use Eshe.

These Terms form the contractual framework between the user and Eshe. They define:

  • what Eshe is;

  • what features may be available to the user;

  • what restrictions apply to the use of the service;

  • what Eshe is not;

  • what obligations the user has;

  • what rights Eshe has to protect the service, users, content, infrastructure, and the company’s legal position.

The processing of the user’s personal data is governed separately by the Eshe Privacy Policy. These Terms do not replace the Privacy Policy and apply together with it.


2. Who Provides Eshe

Unless expressly stated otherwise in a separate document, local notice, or special term for a specific jurisdiction, the Eshe service is provided by:

In these Terms, “Eshe,” “we,” “us,” and “our” mean FEM HEALTH LIFE LIMITED, unless the context clearly indicates otherwise.

The user may contact Eshe regarding these Terms, the operation of the service, account, subscription, or other user-related matters using the contact details provided above.


3. Acceptance of These Terms

The user accepts these Terms when the user:

  • creates an Eshe account;

  • signs in to the application;

  • uses any Eshe feature;

  • interacts with the AI assistant;

  • views or publishes content;

  • leaves comments or participates in community / forum features;

  • uploads images, videos, voice messages, or other materials;

  • purchases a subscription or uses paid features;

  • continues to use Eshe after these Terms have been updated, where such continued use is permitted by applicable law as acceptance of the updated terms.

By accepting these Terms, the user confirms that the user:

  • has the right to accept these Terms on their own behalf;

  • has reached the age required to use Eshe in accordance with these Terms and applicable law;

  • has the right to use the service and, where applicable, make payments;

  • does not use Eshe in a way that violates applicable law, third-party rights, or these Terms.

If the user uses Eshe on behalf of an organization, partner, employer, educational institution, access program, family, group, or another person, the user confirms that they have the necessary authority to use Eshe and accept the relevant terms to the applicable extent.

Certain Eshe features may have additional terms, notices, rules, restrictions, consents, or disclaimers. If the user uses such a feature, both these Terms and the relevant additional rules may apply.

If there is a conflict between these Terms and special terms for a specific feature, the special terms apply to that feature to the extent that they expressly govern the relevant scenario.

Use of paid features, subscriptions, app stores, payment providers, or third-party platforms may also be governed by the terms of the relevant store, platform, or payment provider.


4. Relationship with the Privacy Policy and Other Documents

Use of Eshe involves the processing of the user’s personal data. Such processing is governed by the Eshe Privacy Policy, which explains:

  • what categories of data Eshe processes;

  • for what purposes they are used;

  • on what legal bases;

  • what third-party services may be involved in the processing;

  • what rights the user has in relation to personal data;

  • how Eshe approaches data retention, deletion, security, and cross-border processing.

Before using Eshe, the user is given the opportunity to review the Privacy Policy. The user should understand that the processing of personal data when using Eshe is governed by the Privacy Policy and applicable notices related to specific service features.

These Terms may also apply together with:

  • special notices inside the application;

  • rules for community / forum features;

  • subscription terms;

  • AI disclaimers;

  • medical disclaimers;

  • rules of platforms, app stores, and payment providers;

  • other documents that Eshe may provide in connection with specific features or scenarios.


5. What Eshe Is

Eshe is a digital service in the field of women’s health and wellbeing, designed to provide informational, educational, wellbeing, and self-management support to the user.

Depending on the product version, country, device, subscription, and available features, Eshe may include:

  • cycle calendar and tracking;

  • recording of symptoms, conditions, wellbeing, and user observations;

  • mini check-ups and interactive user scenarios;

  • AI assistant and AI features;

  • content sections, articles, materials, and general informational prompts;

  • reminders and notifications;

  • comments, community / forum features, and user publications;

  • uploading of images, videos, voice messages, and other materials;

  • free and paid features;

  • subscriptions and other related digital services.

Eshe is intended to help the user organize their own observations and information about themselves, receive general informational support, and use digital self-observation features.

Eshe may personalize certain elements of the user experience based on data that the user provides or records in the application, within the limits described in the Privacy Policy and applicable service settings.

The availability of specific features may depend on country, language, application version, device, operating system, subscription, technical configuration, legal requirements, or Eshe’s internal product development decisions.


6. What Eshe Is Not

Eshe is not a medical organization, clinic, hospital, doctor, licensed healthcare professional, emergency service, medical monitoring system, or diagnostic and treatment service.

Eshe is not intended to:

  • provide a medical diagnosis;

  • prescribe treatment;

  • prescribe medication;

  • replace consultation with a doctor or another qualified healthcare professional;

  • provide emergency medical assistance;

  • monitor acute, dangerous, or life-threatening conditions;

  • detect emergency conditions in real time;

  • make urgent medical decisions instead of the user or a healthcare professional.

Eshe content, AI responses, mini check-ups, tracking, reminders, prompts, materials, and other features are informational, educational, wellbeing, supportive, or self-management in nature. They are not a medical opinion, diagnosis, treatment prescription, medical prescription, or individual medical consultation.

Any conclusions, prompts, or results inside Eshe should be treated as supporting information, not as a professional medical assessment.

Eshe is not obligated to detect emergency conditions, monitor the user’s condition in real time, or warn the user about all possible medical risks.

If the user experiences symptoms that may indicate a serious condition, worsening health, a life-threatening situation, or the need for urgent medical assistance, the user must immediately contact a qualified healthcare professional or local emergency services.

The user must not delay seeking professional medical assistance, ignore a doctor’s recommendations, or independently change treatment based on information received through Eshe.


7. Eligibility to Use Eshe and Age Restrictions

Eshe is generally intended for users aged 18 and older.

By using Eshe, the user confirms that:

  • they have reached the age required to independently use the service in their jurisdiction;

  • they have the right to accept these Terms;

  • their use of Eshe does not violate applicable law;

  • if the user uses paid features, they have the right to make the relevant payments or have obtained the necessary permissions.

If applicable law permits a person under the age of 18 to use certain Eshe features only with the involvement, permission, or consent of a parent or legal guardian, such use is permitted only where the relevant legal requirements and Eshe rules are complied with.

Eshe does not guarantee the availability of all features to minor users, even if the use of certain features by persons under 18 is permitted under local law. Certain features, including AI scenarios, community / forum features, paid features, features involving sensitive data, or other higher-risk areas, may be restricted or unavailable to minor users.

If Eshe learns or reasonably suspects that a user is using the service in violation of age requirements, without the necessary permission, or in violation of applicable law, Eshe may:

  • restrict access to the account;

  • suspend the use of certain features;

  • request additional confirmation of age or the right to use the service;

  • delete the account;

  • delete or restrict the processing of the relevant data;

  • take other reasonable measures necessary to comply with the law and protect the user, the service, and Eshe’s legal position.

Certain Eshe features may have additional age restrictions, especially where they relate to sensitive data, community features, paid services, AI scenarios, or other higher-risk areas.


8. Account, Registration, and Account Security

To use certain Eshe features, the user may need to create an account or sign in to the service using a supported sign-in method, including phone, WhatsApp, email, Google, Apple, or another available method.

The user agrees to provide accurate, up-to-date, and non-misleading information when creating and using an account.

The user is responsible for:

  • maintaining the confidentiality of their credentials;

  • the security of the device from which they use Eshe;

  • controlling access to their account;

  • actions performed through their account, where such actions became possible due to sharing access, insufficient device protection, or other circumstances on the user’s side;

  • promptly notifying Eshe if the user suspects unauthorized access to the account.

The user understands that third-party access to their device, email, phone number, messenger, sign-in method, or account may allow such persons to access information in Eshe, including sensitive information, if the device, credentials, or related access channels are not properly protected.

The user must take reasonable measures to protect their device and account, including using available device lock mechanisms, secure passwords, operating system settings, and other safeguards that help prevent unauthorized access.

The user must not:

  • transfer their account to third parties;

  • use another user’s account;

  • create an account on behalf of another person without a lawful basis;

  • bypass registration, authentication, payment, or access restriction mechanisms;

  • use Eshe in a way that compromises service security, the rights of other users, or these Terms.

Eshe may restrict, suspend, or block access to an account or certain features if Eshe has reasonable grounds to believe that:

  • the account is being used in violation of these Terms;

  • the account has been compromised;

  • there is a risk of unauthorized access;

  • the user has provided inaccurate information;

  • the account is being used for abuse, unlawful actions, violation of other persons’ rights, or circumvention of service restrictions;

  • such restriction is necessary to protect the user, other users, data, infrastructure, or Eshe’s legal position.

Access restrictions may be temporary or permanent, depending on the nature of the violation, risk, legal requirements, and the need to protect the service.


Product Scope / Features and Limitations

9. Use of Eshe Features

Eshe provides digital features that may help the user organize information about themselves, record observations, receive general informational support, and use certain self-observation tools.

Depending on the product version, country, language, device, operating system, subscription, and technical configuration, Eshe may include:

  • cycle calendar and tracking;

  • recording of symptoms, conditions, wellbeing, medication intake, and user observations;

  • mini check-ups and interactive scenarios;

  • AI assistant and AI features;

  • articles, educational materials, informational prompts, and content sections;

  • reminders and notifications;

  • comments, community / forum features, and user publications;

  • uploading of images, videos, voice messages, and other materials;

  • free and paid features;

  • subscriptions and other related digital services.

Eshe may change, supplement, limit, temporarily suspend, or remove certain features where this is related to product development, technical changes, legal requirements, security, service quality, the commercial model, or Eshe’s internal decisions.

The availability of a specific feature is not guaranteed for all users, countries, devices, application versions, or account types. Some features may be available only in certain countries, languages, application versions, subscriptions, or user scenarios.

The user understands that certain results, prompts, visualizations, reminders, AI responses, tracking, mini check-ups, and other Eshe elements depend on:

  • the data that the user enters or provides;

  • the accuracy, completeness, and timeliness of the user’s input;

  • the settings and scenarios selected by the user;

  • the technical functionality of the device, application, and network connection;

  • the availability of the relevant feature in the specific version of the service;

  • limitations of digital, analytics, and AI technologies.

Eshe may take reasonable measures to maintain the quality, safety, accuracy, and functionality of its features. However, Eshe does not guarantee that results, prompts, predictions, reminders, AI responses, or other elements of the service will be fully accurate, complete, timely, applicable to every individual user situation, or free from errors.

Any conclusions, prompts, results, materials, or responses within Eshe should be treated as supporting information, not as a professional medical assessment.


10. Health Information, Self-Observation Features, and Medical Disclaimer

Eshe may provide the user with features related to women’s health and wellbeing, including a cycle calendar, symptom tracking, mini check-ups, informational materials, reminders, AI responses, and other self-observation features.

Such features are intended to:

  • organize the user’s observations;

  • record information that the user chooses to enter;

  • support personal self-observation;

  • provide general informational and educational support;

  • help the user interact with information about themselves in a more structured way.

Such features are not intended to:

  • provide a diagnosis;

  • confirm or rule out a disease or medical condition;

  • prescribe treatment;

  • prescribe, cancel, or change medication;

  • replace a medical examination;

  • replace consultation with a doctor, pharmacist, psychologist, health advisor, or other qualified professional;

  • make urgent or critical health decisions;

  • provide emergency assistance;

  • monitor the user’s condition in real time.

Information provided through Eshe, including tracking data, mini check-up results, AI responses, articles, materials, prompts, reminders, and notifications, is informational, educational, wellbeing, supportive, or self-management in nature.

Eshe does not confirm that the user has or does not have any specific medical condition. Eshe does not provide individual medical advice, a medical opinion, diagnosis, treatment prescription, or medical prescription.

If the user has symptoms, health complaints, health-related questions, suspected illness, worsening condition, pregnancy, complications, pain, psychological distress, unusual discharge, bleeding, severe pain, signs of infection, risk of violence, threat to life, or any other condition that may require professional assessment, the user should contact a qualified healthcare professional.

This list is provided as an example and is not exhaustive. The user should seek professional help in all cases where their condition, symptoms, circumstances, or level of risk require medical, psychological, pharmaceutical, social, emergency, or other professional assessment.

In an emergency, the user must immediately contact local emergency services or a qualified healthcare professional. Eshe is not an emergency service and does not undertake to detect emergency conditions, monitor the user’s condition in real time, or warn the user about all possible medical risks.

The user must not delay seeking professional medical help, ignore recommendations from a healthcare professional, stop or change treatment, dosage, medication intake, or a medical plan based on information received through Eshe.


11. AI Assistant and AI Responses

Eshe may include an AI assistant and other AI features that help the user interact with the service’s digital scenarios, ask questions, receive informational responses, structure observations, and use certain application features.

AI responses are generated based on:

  • the user’s request;

  • information that the user provides;

  • limited relevant context available to the relevant feature;

  • the technical logic of the AI scenario;

  • the settings and architecture of the service;

  • limitations of the AI technologies used.

The user understands that AI responses may be:

  • incomplete;

  • inaccurate;

  • outdated;

  • incorrectly interpreted;

  • not applicable to the user’s specific situation;

  • based on incomplete or incorrect information provided by the user;

  • generated subject to the limitations of AI technologies.

AI responses may sound confident even where they are incomplete, inaccurate, incorrect, or not applicable to the user’s specific situation. The user should take this into account when considering any AI response.

The Eshe AI assistant is not a doctor, healthcare professional, psychologist, pharmacist, emergency operator, or substitute for professional consultation.

AI responses are not:

  • a diagnosis;

  • a medical opinion;

  • a treatment prescription;

  • a medical prescription;

  • an individual medical recommendation;

  • confirmation of the safety or effectiveness of any particular action;

  • a basis for stopping, changing, or starting treatment;

  • emergency medical assistance.

If an AI response appears personalized or takes into account data that the user has provided in Eshe, this does not mean that such response is individual medical advice, a professional medical assessment, or a substitute for consultation with a qualified specialist.

The user must not use Eshe AI features as the only source of information for decisions related to health, treatment, medication, pregnancy, symptoms, mental state, safety, or an urgent medical situation.

If an AI response causes doubt, concern, confusion, or relates to a situation that may have medical significance, the user should contact a qualified professional.

Eshe may update, change, limit, suspend, or disable AI features in whole or in part where necessary for:

  • improving service quality;

  • user safety;

  • compliance with law;

  • risk management;

  • technical resilience;

  • abuse prevention;

  • changes to product architecture;

  • termination or modification of arrangements with external AI technology providers.

Eshe does not guarantee that AI features will be available continuously, in all countries, in all languages, to all users, or for all types of requests.


12. User Responsibility When Using Health and AI Features

The user is responsible for the information they enter, record, submit, upload, or publish in Eshe, including information related to health, wellbeing, symptoms, cycle, medication intake, personal circumstances, images, videos, voice messages, and other user content.

The user understands that the quality, relevance, and applicability of certain Eshe features may depend on the accuracy and completeness of the information they provide.

The user agrees to:

  • use Eshe reasonably and in good faith;

  • not use Eshe for emergency medical assistance;

  • not use Eshe as a substitute for a doctor or qualified professional;

  • not rely solely on AI responses, tracking, mini check-ups, articles, or prompts when making medically significant decisions;

  • contact a qualified professional where the situation requires professional assessment;

  • not enter knowingly false, harmful, or misleading data for the purpose of abusing the service;

  • not upload or disclose through Eshe personal data, medical information, images, voice, video, or other information of third parties without an appropriate right, consent, or legal basis;

  • not use Eshe to spread dangerous medical misinformation, harmful advice, threats, violence, harassment, or other unlawful conduct.

If the user uses Eshe to keep personal observations, the user independently assesses what information is appropriate, accurate, and necessary to enter into the service.

If the user shows data from Eshe to a doctor, specialist, partner, family member, or another third party, the user does so by their own decision and is responsible for such disclosure, unless otherwise provided by law.

To the extent permitted by applicable law, Eshe is not liable for decisions made by the user solely on the basis of the user’s interpretation of information, AI responses, tracking, mini check-ups, content, or other Eshe features, where such decisions were made without consulting a qualified professional in circumstances where such consultation was reasonably necessary.

This section does not release Eshe from obligations that cannot be excluded or limited under applicable law, but establishes reasonable boundaries for the use of the service’s health and AI features.


13. Changes, Limitations, and Development of Eshe Features

Eshe is continuously evolving. The user understands that features, interfaces, scenarios, AI mechanisms, content sections, community capabilities, paid features, and other elements of the service may change over time.

Eshe may, at its reasonable discretion:

  • add new features;

  • change existing features;

  • limit certain features;

  • temporarily suspend features;

  • remove features;

  • change feature availability by country, language, application version, device, or subscription type;

  • change the technical or product logic of certain scenarios.

Such changes may be related to:

  • product development;

  • security requirements;

  • legal requirements;

  • technical limitations;

  • changes in providers or integrations;

  • changes in the commercial model;

  • quality of the user experience;

  • risk management for health, AI, community, or privacy scenarios.

If a change materially affects a paid feature, active subscription, or user rights, Eshe may provide notice in a reasonable form where such notice is required by law, platform terms, or the nature of the change.


User Content, Community, Uploads, and Rules of Conduct

14. User Content

In certain Eshe features, the user may create, upload, send, publish, or otherwise provide content. Such content may include:

  • messages in the AI chat;

  • comments under publications;

  • posts, topics, replies, and other materials in community / forum features;

  • images;

  • videos;

  • voice messages;

  • screenshots;

  • text notes;

  • other materials that the user voluntarily provides through supported Eshe features.

In these Terms, such content is referred to as “User Content.”

The user understands that different Eshe features have different visibility regimes for User Content:

  • content submitted to a private AI chat or another personal scenario is intended for use within the relevant feature and is not intended for publication to other users;

  • comments, posts, replies, community / forum materials, and other content posted in spaces intended for interaction with other users may be visible to other users within the relevant feature;

  • certain features may have additional rules on visibility, publication, moderation, retention, or deletion of content.

The user independently decides what content to provide to Eshe, except where a particular input is necessary for the operation of the selected feature. The user should understand that User Content may contain sensitive information, including health data, body images, voice, personal circumstances, location information, third-party information, or other information that the user may not want to disclose to others.

The user must not publish or upload content unless the user is prepared for the use, processing, and visibility regime provided by the relevant Eshe feature.

The user confirms that they have all rights, permissions, consents, and lawful grounds necessary to provide the relevant User Content through Eshe, and that such content does not violate the rights, privacy, safety, dignity, intellectual property rights, or legitimate interests of third parties.

User Content may contain personal data. The processing of personal data contained in User Content is governed by the Eshe Privacy Policy.


15. User Rights to Content and Eshe’s Limited License

The user retains rights to User Content that the user creates, uploads, or publishes in Eshe, to the extent such rights belong to the user.

By providing User Content through Eshe, the user grants Eshe a limited, non-exclusive, royalty-free license, applicable only within the operation of the service, to use such content to the extent necessary to provide, technically support, protect, and maintain the relevant feature.

The royalty-free nature of this license means that Eshe does not pay the user separate compensation for the technical use of User Content within the operation of the service, unless expressly agreed otherwise separately.

This license may include Eshe’s right to:

  • receive, store, and technically process User Content;

  • reproduce User Content to the technical extent necessary for the operation of the feature;

  • display the content to the user;

  • display the content to other users, if the content is posted in the community / forum, comments, or another feature intended for interaction with other users;

  • format, compress, adapt, transcode, or technically transform images, videos, audio, voice messages, or other materials where necessary for upload, storage, display, security, or feature compatibility;

  • use the content for the operation of an AI feature, if the user has submitted such content into the relevant AI scenario;

  • moderate, review, hide, restrict, block, or delete content in accordance with these Terms;

  • ensure the security, resilience, protection of users, and proper operation of the service;

  • review complaints, inquiries, violations, disputes, or lawful requests;

  • retain technical, backup, cached, or other limited copies within the limits permitted by these Terms, the Privacy Policy, and applicable law;

  • perform other technical, legal, and operational actions necessary to provide the relevant Eshe feature.

This license does not mean that Eshe becomes the owner of User Content. It is necessary so that Eshe can technically and legally operate the features in which User Content is created, uploaded, displayed, processed, moderated, or deleted.

The license remains in effect for the period during which User Content is stored, displayed, or processed in Eshe in accordance with these Terms, the Privacy Policy, and applicable law.

If the user deletes content or the account, the license for active use of such content terminates to the extent applicable to the relevant feature and permitted by law. However, certain copies, records, or information may be retained for a limited period where necessary for:

  • compliance with law;

  • security;

  • backup recovery;

  • investigation of violations;

  • handling complaints or disputes;

  • protection of the legal position of Eshe, users, or third parties;

  • compliance with internal retention, deletion, and backup rules.

Rules on the retention and deletion of personal data and User Content are further described in the Eshe Privacy Policy.


16. Community / Forum, Comments, and Interaction Spaces

Eshe may provide features that allow users to interact with each other, including comments, discussions, community / forum sections, publications, replies, and other social or semi-public scenarios.

The user understands that such features differ from personal self-observation features, the calendar, tracking, or private AI chat. Content posted in the community / forum, comments, or other interaction spaces may be visible to other users within the relevant feature.

The user is responsible for the content they publish in such spaces and must use them in good faith, respectfully, and safely for other users.

Content published by other users in the community / forum, comments, or other interaction spaces is not medical advice, is not reviewed by Eshe as a professional medical recommendation, and must not be used as a basis for diagnosis, treatment, stopping medication, changing dosage, refusing professional help, or making urgent health decisions.

Eshe does not confirm the accuracy, completeness, safety, medical correctness, or applicability of User Content published by other users. The user should critically assess such content and contact a qualified specialist if the matter relates to health, treatment, medication, pregnancy, symptoms, mental state, safety, or an urgent medical situation.

The user must not publish in the community / forum, comments, or other interaction spaces:

  • unlawful content;

  • threats, calls for violence, harassment, or intimidation;

  • insults, bullying, humiliation, discriminatory statements, or hate speech;

  • content that violates the rights, safety, dignity, or privacy of other persons;

  • personal data, health data, images, voice, video, or other information about third parties without an appropriate right, permission, or legal basis;

  • dangerous medical misinformation;

  • advice that may harm the health or safety of other users;

  • instructions on self-treatment, stopping treatment, changing medication dosage, or refusing professional help where such instructions may create a risk of harm;

  • content that presents itself as professional medical advice if the user does not have the right to provide such advice;

  • false claims that the user is a doctor, healthcare professional, psychologist, pharmacist, cosmetologist, consultant, Eshe representative, Eshe partner, or other professional person;

  • professional, medical, psychological, pharmaceutical, or other advice if the user does not have the right to provide such advice or if providing it violates applicable law, professional rules, or platform requirements;

  • advertising, spam, fraudulent offers, manipulative schemes, or unauthorized commercial publications;

  • content that violates third-party intellectual property rights;

  • harmful links, files, code, malware, or other technically dangerous materials;

  • sexual, exploitative, violent, or other content prohibited by law or Eshe rules;

  • any other content that Eshe reasonably considers incompatible with the safety, purpose, rules, user environment, or permitted use of the service.

If the user is in fact a doctor, healthcare professional, psychologist, pharmacist, consultant, or other professional, the user must still comply with applicable law, professional rules, confidentiality requirements, rules of the relevant profession, and these Terms. Use of Eshe does not give such user the right to conduct unlawful medical, psychological, pharmaceutical, or other professional practice through the community / forum or comments.

Unless Eshe expressly states otherwise, Eshe does not verify, confirm, or guarantee the professional status, qualifications, licenses, authority, or experience of users who publish content in the community / forum, comments, or other interaction spaces.

Eshe may establish additional rules for specific community / forum sections, topics, campaigns, events, partner spaces, or user scenarios.


17. Uploaded Images, Videos, Voice Messages, and Other Materials

If the user uploads images, videos, voice messages, screenshots, or other materials into Eshe, the user confirms that:

  • they do so voluntarily;

  • they have the right to upload such materials;

  • such materials do not violate the rights, privacy, safety, dignity, or legitimate interests of third parties;

  • such materials do not contain unlawful, harmful, offensive, exploitative, or prohibited content;

  • if the materials contain data of third parties, the user has the appropriate right, permission, or legal basis to provide them;

  • the user understands that such materials may contain sensitive information and should be uploaded with caution.

Uploading materials into the AI chat or another private scenario does not mean that such content becomes public. However, it may be processed within the relevant feature so that Eshe can provide a response, technical processing, or another result provided by that scenario.

Uploading materials into the community / forum, comments, or other interaction spaces may make such materials visible to other users within the relevant feature.

The user must not upload:

  • materials containing another person’s personal data or health data without a lawful basis;

  • materials that violate the privacy, honor, dignity, safety, or rights of other persons;

  • images, videos, or voice materials obtained without the consent of the relevant persons where such consent is required;

  • materials related to violence, exploitation, harassment, threats, sexual violence, unlawful activity, or other harmful behavior;

  • materials that may create a risk of harm to the user, other users, Eshe, infrastructure, or third parties.

Eshe may restrict, hide, delete, or block such materials in accordance with these Terms, applicable law, platform rules, security requirements, or internal moderation rules.


18. Moderation, Restriction, and Removal of Content

Eshe has the right to moderate User Content to the extent necessary to protect users, the service, data, infrastructure, community spaces, partner scenarios, and the company’s legal position.

Moderation and review measures are applied taking into account the nature of the feature, the visibility regime of the content, and applicable law. Content in private scenarios and content in community / forum, comments, or other interaction spaces may be processed and reviewed under different rules.

Moderation may be carried out using manual, automated, or mixed procedures. Eshe may use technical tools, internal rules, user complaints, risk signals, automated checks, manual review, or other reasonable methods to detect and process content that may violate these Terms, the law, or service rules.

Eshe may, at its reasonable discretion:

  • review User Content;

  • hide or restrict the visibility of content;

  • delete content;

  • restrict the ability to publish;

  • temporarily or permanently restrict the user’s access to community / forum features;

  • temporarily or permanently restrict access to the account or certain features;

  • block materials, links, files, or actions that create a risk of harm;

  • apply stricter measures in the case of repeated, serious, dangerous, or intentional violations;

  • retain limited information about a violation where necessary for security, complaint handling, dispute resolution, investigation, or compliance with law.

Eshe may take moderation measures without prior notice to the user where necessary for safety, protection of other users, prevention of harm, compliance with law, protection of infrastructure, prevention of abuse, or preservation of evidence of a violation.

Eshe does not undertake to review all User Content before publication and does not guarantee that any harmful, inaccurate, unlawful, offensive, or rule-violating content will be detected immediately.

The existence of Eshe’s moderation rights does not create a general obligation for Eshe to actively monitor all User Content, pre-screen every publication, or guarantee the absence of violating content in the service.

If the user sees content that, in the user’s opinion, violates these Terms, the user’s rights, the safety of other persons, or applicable law, the user may report it to Eshe through available communication channels or complaint mechanisms, where such mechanisms are available in the relevant feature.

Eshe may take action on complaints, but does not guarantee a specific outcome, a specific review timeframe, or mandatory removal of any content if Eshe does not consider such action necessary, lawful, or proportionate.

When choosing a moderation measure, Eshe may take into account the nature of the content, publication context, risk of harm, repeated nature of the violation, user action history, legal requirements, rights of other persons, service security, and other circumstances that Eshe considers relevant.

Moderation does not mean that Eshe endorses, confirms, verifies, or assumes responsibility for all User Content published by users.


19. Prohibited Conduct

The user agrees not to use Eshe in a way that violates the law, the rights of other persons, service security, the purpose of the product, or these Terms.

The user is prohibited from:

  • using Eshe for unlawful, harmful, fraudulent, aggressive, or bad-faith purposes;

  • impersonating another person, organization, healthcare professional, Eshe representative, or third party without the appropriate right;

  • using Eshe for harassment, bullying, threats, exploitation, manipulation, discrimination, or violation of the rights of other users;

  • publishing or spreading dangerous medical misinformation;

  • using Eshe to provide medical consultations, diagnoses, treatment prescriptions, or instructions if the user does not have the legal right to do so;

  • using Eshe as a tool for emergency medical assistance, diagnosis, or treatment;

  • uploading, publishing, or transmitting malicious code, malware, spyware, phishing links, spam, or other technically harmful content;

  • attempting to gain unauthorized access to accounts, data, systems, APIs, infrastructure, or internal Eshe services;

  • bypassing technical, payment, age, regional, functional, or security restrictions;

  • using automated tools, scraping, bots, reverse engineering, decompilation, unauthorized extraction, or other methods of accessing, copying, or analyzing the service without Eshe’s permission, except where such right is expressly provided by law;

  • interfering with the operation of the service, overloading infrastructure, disrupting system stability, or degrading Eshe’s operation for other users;

  • using Eshe for unauthorized commercial activity, advertising, sale of goods or services, customer acquisition, contact collection, or promotion of third-party products without Eshe’s permission;

  • violating the intellectual property rights of Eshe or third parties;

  • collecting, disclosing, or using personal data of other users without an appropriate right;

  • abusing complaint, support, moderation, or feedback mechanisms, including by submitting knowingly false, bad-faith, harassing, manipulative, or repetitive complaints;

  • using Eshe in a way that may harm users, Eshe, partners, infrastructure, reputation, or the company’s legal position.

Eshe may take measures in response to a violation of this section, including issuing a warning, removing content, restricting features, temporarily or permanently blocking an account, terminating access, preserving evidence of the violation, or contacting platforms, payment providers, or competent authorities where necessary and permitted by law.

Repeated, serious, dangerous, intentional, or unlawful violations may result in stricter measures, including permanent restriction of access to the account or certain Eshe features.


20. Complaints About User Content and Violations

If the user believes that content or actions of another user violate these Terms, the law, the user’s rights, privacy, safety, or the rules of community / forum features, the user may submit a complaint to Eshe through available support channels or special complaint tools, where such tools are provided in the relevant feature.

When submitting a complaint, the user should, where possible, provide information sufficient for its review, such as:

  • a description of the violation;

  • a link, screenshot, or other identifier of the disputed content;

  • the reason why the user believes the content or action violates the rules;

  • information necessary to contact the user if a response is required.

The user must not use complaint mechanisms for harassment, pressure on other users, knowingly false reports, abuse of moderation, retaliation, bad-faith removal of permissible content, or disruption of the normal operation of the service.

Eshe may review complaints taking into account:

  • the nature of the content;

  • the risk to users;

  • applicable law;

  • rules of community / forum features;

  • repeated nature of the violation;

  • history of actions of the relevant user;

  • the need to protect the privacy and rights of other persons;

  • technical ability to verify the circumstances.

Eshe may take action on a complaint, refuse to take action, request additional information, or limit the review if the complaint is unfounded, insufficiently specific, abusive, repetitive, or does not allow a violation to be established.

Eshe does not undertake to disclose to the user all details of complaint review where such disclosure may violate the privacy of other persons, service security, internal moderation rules, Eshe’s legitimate interests, or legal requirements.


Payments, Subscriptions, Third-Party Services, and Availability

21. Free and Paid Features

Eshe may provide some features free of charge and other features on a paid basis, including subscriptions, premium features, special scenarios, extended content, AI features, or other digital capabilities.

The availability of free access to certain features does not mean that such features will always remain free, unchanged, or available to all users. Eshe may change the scope of free and paid features where this is related to product development, the commercial model, legal requirements, technical limitations, security, service quality, or Eshe’s internal decisions.

A paid feature or subscription provides the user with access to certain Eshe digital capabilities within the relevant plan, period, country, platform, device, and current product configuration.

Payment for a subscription or paid feature does not mean that Eshe provides a medical service, medical consultation, diagnosis, treatment, guaranteed result, guaranteed health improvement, or access to emergency assistance. All limitations described in the sections on health information, AI features, and the medical disclaimer also apply to Eshe paid features.

The user understands that paid features may evolve, change, be replaced, combined, limited, or discontinued. If a change materially affects an active paid feature, subscription, or user rights, Eshe may provide notice in a reasonable form where such notice is required by law, platform rules, or the nature of the change.


22. Subscriptions, Payments, and Access Activation

If the user purchases a subscription or paid feature, the user agrees to pay the relevant price indicated at the time of purchase, subject to applicable taxes, fees, platform rules, and payment provider terms.

Depending on the selected payment method, payment may be processed through:

  • Apple App Store;

  • Google Play;

  • M-Pesa;

  • another mobile payment service;

  • a payment provider;

  • a partner program;

  • a corporate, educational, grant-based, donor-funded, insurance, third-party payer, or other access program;

  • another method supported by Eshe in a specific country or product version.

The user understands that the payment provider, app store, mobile operator, bank, platform, or other intermediary may apply its own terms, fees, billing rules, cancellation rules, refund rules, exchange rates, taxes, and payment confirmation procedures.

Eshe may receive limited information from the relevant platform or payment provider that is necessary to confirm payment, activate access, verify subscription status, prevent abuse, and support the paid feature. The processing of personal data in such scenarios is governed by the Eshe Privacy Policy and, where applicable, by the policies of the relevant third-party providers.

Access to a paid feature may be activated after successful confirmation of payment or access eligibility. In certain cases, especially with mobile payments, M-Pesa, direct payment, partner, or special payment scenarios, payment confirmation and access activation may occur with a delay.

If payment fails, is cancelled, disputed, refunded, declared invalid, cannot be confirmed, or cannot be matched to the user’s account, Eshe may decline to activate access, temporarily restrict access, request additional information, or terminate access to the relevant paid feature.

The user is responsible for keeping payment information up to date, ensuring sufficient funds, selecting the correct payment method, and complying with the terms of the relevant payment platform or provider.


23. Trial Periods, Promotional Access, and Automatic Subscription Renewal

Eshe may provide trial periods, promotional access, discounts, promo codes, special offers, or temporary free access to certain paid features.

If a trial period or promotional access automatically converts into a paid subscription, the key terms of such conversion must be made available to the user at the time the relevant access is activated or in the payment interface of the relevant platform. Such terms may include:

  • the duration of the trial period;

  • the price after the trial period ends;

  • the billing frequency;

  • the date or condition on which the paid period begins;

  • the cancellation method;

  • the rules of the platform or payment provider.

If a subscription is purchased as an automatically renewable subscription, the user understands and agrees that the subscription may automatically renew for the next billing period unless the user cancels it in accordance with the rules of the relevant platform, app store, payment provider, or Eshe before the renewal date.

The terms of automatic renewal, subscription period, price, billing date, cancellation procedure, and notification rules may depend on:

  • Apple App Store;

  • Google Play;

  • M-Pesa or another payment scenario;

  • the user’s country;

  • subscription type;

  • current plan;

  • platform or payment provider terms.

Eshe may not have the technical ability to cancel a subscription purchased through Apple App Store, Google Play, or another third-party app store if the rules of that platform require the user to cancel the subscription directly through the relevant platform.

The user must independently monitor subscription status, renewal date, and cancellation rules in the relevant app store, payment system, or account through which the subscription was purchased.


24. Prices, Taxes, Currency, Fees, and Price Changes

Eshe may offer different plans, prices, access periods, trial periods, promotional access, discounts, promo codes, or special access terms. Such terms may differ depending on the country, platform, app store, payment method, partner program, device, application version, or marketing campaign.

Prices may be displayed in local currency, platform currency, or another currency supported by the relevant payment scenario. Exchange rates, bank fees, mobile operator fees, payment provider fees, app store charges, tax charges, and other fees may apply separately and may be outside Eshe’s reasonable control.

Eshe may change prices, plan contents, available subscription periods, discount terms, trial periods, and special offers. If a price change affects an active automatically renewable subscription, such change applies in accordance with the rules of the relevant platform, payment provider, and applicable law.

In some cases, the user may receive notice of the new price, may be required to confirm the price change, or may lose access to the subscription if the user does not accept the new terms, depending on the rules of App Store, Google Play, M-Pesa, the payment provider, or applicable law.

Unless expressly stated otherwise, a price change applies to future billing periods and does not automatically recalculate a period that has already been paid for.


25. Subscription Cancellation, Account Deletion, and Termination of Paid Access

The user may cancel a subscription or terminate paid access in accordance with the rules of the relevant purchase method.

If the subscription was purchased through Apple App Store or Google Play, cancellation is usually carried out through the subscription settings of the relevant app store. Eshe does not fully control cancellation, renewal, refund, or payment dispute processes that are governed by the rules of Apple, Google, or other third-party platforms.

If access was purchased through M-Pesa, another mobile payment service, direct payment, partner program, corporate program, third-party payer, grant-based access, or another special scenario, the rules for cancellation, access termination, and possible refund may be determined by the relevant scenario, program terms, payment provider terms, and applicable law.

Cancellation of a subscription may stop future charges, but does not always mean an immediate refund of an amount already paid. After cancellation, the user may retain access to the paid feature until the end of the already paid period, where provided by the relevant subscription terms, platform rules, or applicable law.

Deleting the application itself may not cancel an active subscription if the subscription was purchased through an app store, payment provider, or another third-party platform. The user must cancel the subscription through the relevant cancellation mechanism.

Deleting the Eshe account may also not automatically cancel a subscription purchased through Apple App Store, Google Play, M-Pesa, a payment provider, or another third-party channel, if the rules of that channel require separate cancellation. Account deletion may affect the user’s access to paid features, history, settings, and related data, but does not always terminate payment obligations already created through a third-party platform or payment channel.

Eshe may terminate or restrict paid access if:

  • payment is not confirmed;

  • the subscription has expired;

  • the subscription is cancelled;

  • the payment is refunded, disputed, or declared invalid;

  • the user violates these Terms;

  • access was provided under a program that has ended, was cancelled, or no longer applies to the user;

  • such restriction is required by law, a platform, a payment provider, or security considerations.


26. Refunds and Payment Disputes

Refund rules depend on the purchase method, payment platform, user’s country, subscription type, applicable law, and the terms of the relevant payment provider.

If the user purchased a subscription or paid feature through Apple App Store, Google Play, or another app store, refund requests may be reviewed by the relevant platform under its own rules and procedures. Eshe may not be able to independently approve or process a refund if the purchase was made through such a platform.

If payment was made through M-Pesa, a mobile payment service, direct payment, partner channel, or another special scenario, the refund may be reviewed in accordance with the rules of the relevant payment scenario, program terms, and applicable law.

If the user believes that a payment was charged in error, access was not activated after confirmed payment, the payment was duplicated, or another payment dispute arose, the user may contact Eshe through available support channels and, where applicable, also contact the relevant payment provider, mobile operator, bank, app store, or platform.

To review a payment issue, Eshe may request reasonably necessary information, such as the payment date, amount, payment method, transaction number, payment confirmation, user account, or other information necessary to verify the payment. The user must not send Eshe full bank card details, PIN codes, passwords, or other secret payment information.

To the extent permitted by applicable law, Eshe does not undertake to provide a refund solely because:

  • the user did not use the paid feature;

  • the user forgot to cancel the subscription;

  • the user deleted the application but did not cancel the subscription;

  • the user deleted the account but did not cancel the subscription through the relevant payment channel;

  • the user expected a different result from the feature;

  • the user misunderstood the limitations of health, AI, or self-management features;

  • the feature was temporarily unavailable for technical reasons, unless such unavailability gives the user a right to a refund under law or platform terms;

  • the user did not install an update required for the feature to work properly.

Nothing in this section limits the user’s rights to a refund, cancellation, claim, or consumer protection remedies that cannot be excluded or limited under applicable law.


27. Promo Codes, Trial Periods, Partner Access, and Third-Party Payer Access

Eshe may provide access to certain features through promo codes, trial periods, special offers, partner programs, corporate programs, educational programs, grant-based access, donor-funded access, insurance programs, third-party payer models, or other access programs.

Such programs may have separate terms, including:

  • validity period;

  • scope of available features;

  • restrictions by country, organization, user group, or partner;

  • activation rules;

  • access termination rules;

  • prohibition on transferring access to other persons;

  • limits on the number of users;

  • conditions for renewal or conversion to a paid subscription;

  • additional requirements of the platform, partner, or access sponsor.

If access is provided through a partner, employer, educational institution, government, donor-funded, grant-based, insurance, corporate, third-party payer, or other external program, the user understands that termination of participation in such program, expiration of the program, changes to partner terms, or termination of cooperation between Eshe and the relevant party may result in restriction or termination of access to the relevant features.

If the user receives access to Eshe through an external program, this by itself does not mean that the external party receives access to the user’s health data, AI chats, personal entries, or sensitive data. Any transfer of personal or sensitive data to an external party is possible only in accordance with the Eshe Privacy Policy, a separate notice, an applicable legal basis, and the user’s consent where such consent is required by law.

The user must not transfer promo codes, corporate, educational, grant-based, insurance, third-party payer, or other special access to other persons unless the relevant terms expressly permit such transfer.

Eshe may restrict or terminate special access if:

  • the program period has expired;

  • the user no longer meets the program conditions;

  • the partner has ceased participation in the program;

  • access was activated in violation of the terms;

  • a promo code, voucher, corporate access, or partner access was used improperly;

  • such restriction is required by law, security, a platform, a partner, or program terms.


28. Third-Party Services, Platforms, and Integrations

Eshe may use third-party services, platforms, and integrations to support certain features, including sign-in, payments, push notifications, AI features, analytics, infrastructure, content, links, communications, partner offers, and other digital scenarios.

Use of such third-party services may be governed by their own terms, privacy policies, payment rules, platform rules, and technical limitations.

Such third-party services may include, for example:

  • Apple, App Store, and related Apple services;

  • Google, Google Play, and related Google services;

  • M-Pesa and other mobile payment services;

  • WhatsApp, phone-based, or other sign-in mechanisms;

  • AI providers;

  • cloud and infrastructure providers;

  • analytics and attribution services;

  • notification services;

  • partner websites, clinics, laboratories, pharmacies, educational institutions, employers, insurance, corporate, or government programs;

  • other third-party services that may be related to individual Eshe features.

To the extent permitted by applicable law, Eshe is not responsible for the acts, omissions, availability, content, terms, payment decisions, technical failures, changes, or policies of third-party services that are outside Eshe’s reasonable control.

If the user follows a link to a third-party website, uses a third-party payment service, signs in through an external platform, interacts with a partner offer, or uses a feature that depends on a third-party service, the user should review the terms and policies of the relevant party.

The presence of a link, integration, partner offer, routing, CTA, contact, or mention of a third-party service in Eshe does not mean that Eshe guarantees the quality, safety, legality, medical correctness, availability, price, result, or suitability of that third-party service, unless Eshe expressly states otherwise.


29. Partner Offers, External Services, and Redirects to Third Parties

Eshe may display information to the user about partners, clinics, laboratories, pharmacies, specialists, educational programs, insurance products, wellness services, goods, offers, or other external opportunities.

Such information may be provided for user convenience, informational navigation, discovery, routing, communication with a third party, booking, service request, partner scenario, or extension of the user experience.

If the user decides to contact a third party, purchase a product, book a service, follow a link, contact a partner, undergo a laboratory test, contact a clinic, pharmacy, or specialist, or use an external offer, the relationship between the user and that third party may be governed by the separate terms of that third party.

Eshe is not a party to any medical, laboratory, pharmaceutical, insurance, educational, retail, delivery, consultation, booking, or other external service unless Eshe expressly states otherwise.

To the extent permitted by applicable law, Eshe does not guarantee:

  • the availability of an external service;

  • the quality of an external service;

  • the qualifications, licenses, or authority of a third party;

  • the accuracy of information provided by a third party;

  • the price, timing, result, safety, or suitability of an external service;

  • any medical, wellness, financial, educational, commercial, or other result from contacting a third party.

The presence of a partner, link, card, general recommendation, routing, CTA, promo code, special offer, or other mention of a third party in Eshe does not mean that Eshe confirms, guarantees, or assumes responsibility for the service, product, consultation, test, medicine, delivery, booking, appointment, or action of that third party, unless Eshe expressly states otherwise.

Eshe may receive a commercial, partnership, referral, CPA, commission, sponsorship, or other benefit from certain partner offers where permitted by law and the relevant platform rules. This possibility does not change the fact that the external provider is independently responsible for the goods, services, consultations, tests, products, delivery, or other actions it provides, unless Eshe expressly states otherwise.

The existence of such commercial or partnership relationship does not mean that Eshe provides a medical recommendation, guarantees the suitability of the relevant service for a specific user, or replaces professional assessment by a qualified specialist.

If a third-party partner, clinic, laboratory, pharmacy, specialist, or other provider provides a medical, professional, commercial, or other service, responsibility for such service lies with the relevant provider within the limits of its terms and applicable law.


30. Service Availability, Technical Limitations, and Updates

Eshe seeks to maintain the functionality, availability, and resilience of the service. However, Eshe does not guarantee that the service or specific features will always be available without interruptions, errors, delays, limitations, technical problems, or risk of temporary data unavailability.

Eshe availability may depend on:

  • the user’s internet connection;

  • the user’s device;

  • operating system;

  • application version;

  • app store;

  • payment provider;

  • cloud infrastructure;

  • third-party services and integrations;

  • maintenance;

  • updates;

  • security requirements;

  • legal requirements;

  • country, language, region, or account type.

Eshe may temporarily restrict, suspend, or change access to the service or specific features for:

  • maintenance;

  • product updates;

  • error correction;

  • security improvement;

  • abuse prevention;

  • load management;

  • compliance with legal requirements;

  • architecture changes;

  • termination of a third-party service or integration;

  • other reasonable technical, operational, legal, or product-related reasons.

For Eshe to work correctly and securely, the user may need to install application updates, update the operating system, maintain a compatible device, and use the current version of the service.

Eshe may release updates that:

  • fix errors;

  • improve security;

  • change the interface;

  • add, modify, or remove features;

  • change the technical logic of service operation;

  • improve compatibility;

  • ensure compliance with legal, platform, or security requirements.

If the user does not install updates or uses an outdated application version, certain features may work incorrectly, be unavailable, have limited support, or stop working.

Eshe does not guarantee that the service will be supported on all devices, operating systems, application versions, or technical configurations.

To the extent permitted by applicable law, Eshe is not responsible for inability to use the service where such inability is caused by circumstances outside Eshe’s reasonable control, including failures of the internet, the user’s device, operating system, app store, payment provider, third-party service, external platform, force majeure, actions of public authorities, technical accidents, or other events that Eshe could not reasonably prevent.


Legal Protection, Liability, Termination of Access, and Disputes

31. Eshe Intellectual Property

Eshe, including the mobile application, website, software, interfaces, design, texts, visual elements, logos, trademarks, databases, service structure, user scenarios, AI scenarios, content sections, materials, collections, navigation elements, commercial designations, and other components of the service, belongs to Eshe, its affiliates, licensors, partners, or other rights holders, or is used by Eshe on a lawful basis.

Unless expressly stated otherwise in these Terms or in a separate written permission from Eshe, the user does not acquire ownership rights to Eshe, the application, software, brand, content, technologies, interfaces, scenarios, configurations, materials, or other service elements.

The user is granted a limited, personal, non-exclusive, non-transferable, revocable right to use Eshe only for personal, lawful, and permitted purposes in accordance with these Terms.

The user must not, without Eshe’s prior written permission:

  • copy, reproduce, distribute, or publish substantial parts of Eshe;

  • sell, lease, transfer, resell, or commercially exploit access to Eshe;

  • modify, adapt, translate, or create derivative products based on Eshe;

  • remove or hide copyright notices, trademarks, rights notices, or other Eshe markings;

  • use Eshe’s brand, logo, name, visual elements, or materials in a way that may create an impression of partnership, endorsement, or representation without Eshe’s permission;

  • use Eshe to create a competing product or to copy the logic, structure, interface, or user scenarios of Eshe;

  • carry out reverse engineering, decompilation, unauthorized extraction, or other actions aimed at obtaining Eshe’s source code, internal logic, models, data, algorithms, configurations, or architecture, except where such right is expressly granted by law.

A violation of this section may result in access restrictions, content removal, termination of use of the service, claims, and other measures available to Eshe under law.


32. Eshe Content and Informational Materials

Eshe may provide articles, educational materials, informational prompts, visual elements, texts, programs, scenarios, notifications, reminders, collections, user interfaces, and other content.

Such content is provided for informational, educational, wellbeing, supportive, and self-management purposes. It is not medical advice, a diagnosis, treatment, prescription, emergency assistance, or professional assessment.

Unless expressly stated otherwise, the user may use Eshe content only for personal, non-commercial use within the service.

The user must not:

  • copy, publish, sell, or distribute Eshe content outside the service;

  • use Eshe content for commercial consulting, training, resale, marketing, or professional services without Eshe’s permission;

  • present Eshe content as their own;

  • modify Eshe content in a way that misleads other persons;

  • use Eshe materials in medical, psychological, pharmaceutical, educational, commercial, or other professional activities without the proper right and permission, where such permission is required.

Eshe may change, update, remove, limit, or replace content materials without an obligation to keep any specific article, prompt, program, collection, or material permanently available.


33. AI-Generated Outputs and Results of Digital Features

AI responses, prompts, mini check-up results, tracking results, visualizations, reminders, informational elements, and other results of Eshe digital features are provided as supporting information within the service.

Such results:

  • may depend on user input;

  • may be incomplete, inaccurate, outdated, or not applicable to the user’s specific situation;

  • are not a medical opinion, diagnosis, treatment prescription, medical prescription, or individual medical advice;

  • do not guarantee any medical, wellbeing, psychological, behavioral, commercial, or other result;

  • may be similar, analogous, or identical to responses, results, or materials provided to other users.

The user may use AI responses and results of digital features for personal, lawful, and non-commercial purposes, provided that such use:

  • may include sharing such results with a qualified specialist for discussion, provided that such sharing does not mislead the specialist or third parties about the nature of such results;

  • does not present such results as a medical opinion, diagnosis, professional advice, or official position of Eshe;

  • does not violate the rights of third parties;

  • is not used for unlawful medical, psychological, pharmaceutical, commercial, or other professional activity;

  • complies with these Terms and applicable law.

The user does not receive exclusive rights to AI responses, prompts, mini check-up results, tracking results, visualizations, or other digital results. Similar or analogous responses, prompts, structures, wording, scenarios, or results may be provided to other users.

If the user uses AI responses or other results of digital features outside Eshe, the user does so at their own risk and is responsible for ensuring that such use is lawful, reasonable, does not mislead other persons, and does not violate third-party rights.

The user must not present Eshe AI responses, mini check-up results, tracking results, prompts, or other digital results as a professional medical opinion, an official Eshe recommendation, a doctor’s consultation, or confirmation of diagnosis, treatment, safety, or effectiveness of a particular action.

AI models, technologies, infrastructure, components, providers, or external services used to support AI features may belong to Eshe, its providers, licensors, or third parties. The user does not receive rights to such models, technologies, infrastructure, or components, except for the right to use the available Eshe feature within the limits of these Terms.

Eshe may limit, modify, remove, or update AI responses, AI features, algorithmic elements, prompts, visualizations, and other digital results in accordance with product development, security requirements, legal requirements, quality requirements, and risk management.


34. Disclaimers and No Warranties

Eshe is provided to the user in the form and scope available at the relevant time, taking into account the product version, country, language, device, operating system, subscription, technical configuration, and applicable limitations.

To the extent permitted by applicable law, Eshe does not guarantee that:

  • the service will be available continuously, without errors, delays, failures, or limitations;

  • all features will be available in all countries, languages, devices, application versions, or account types;

  • AI responses, prompts, tracking, mini check-ups, notifications, predictions, materials, or other results will be fully accurate, complete, timely, or suitable for every user situation;

  • use of Eshe will lead to any specific medical, wellbeing, psychological, behavioral, educational, commercial, or other result;

  • content published by users or third parties will be accurate, safe, lawful, useful, or verified;

  • third-party services, payment providers, app stores, partners, clinics, laboratories, pharmacies, specialists, or other third parties will be available, reliable, safe, qualified, or suitable for the user;

  • the service will be free from all technical errors, vulnerabilities, external failures, or interference.

Eshe may take reasonable measures to maintain the quality, security, resilience, and proper operation of the service, but no digital service can guarantee absolute accuracy, continuity, security, or applicability of all features in every situation.

Nothing in these Terms excludes or limits any user rights, guarantees, remedies, or Eshe liability that cannot be excluded or limited under applicable law.


35. Limitation of Eshe Liability

To the extent permitted by applicable law, Eshe, its employees, officers, contractors, suppliers, partners, licensors, and affiliates are not liable for:

  • indirect, incidental, special, punitive, consequential, or similar damages;

  • loss of profit, revenue, business opportunity, reputation, or expected benefit;

  • loss, damage, temporary unavailability, or restricted access to data in cases caused by circumstances outside Eshe’s reasonable control or other circumstances for which liability may be limited under applicable law;

  • decisions made by the user solely on the basis of AI responses, tracking, mini check-ups, content, reminders, prompts, or other Eshe features without consulting a qualified specialist where such consultation was reasonably necessary;

  • medical, wellbeing, psychological, behavioral, commercial, or other results that the user expected to obtain from using Eshe;

  • acts, omissions, content, services, goods, consultations, tests, deliveries, payments, or decisions of third-party services, partners, clinics, laboratories, pharmacies, specialists, app stores, payment providers, or other third parties;

  • User Content published, uploaded, or transmitted by other users;

  • unauthorized access to the user’s account or information where such access became possible due to sharing access, insufficient protection of the device, email, phone, messenger, credentials, or other circumstances on the user’s side;

  • inability to use the service, delays, technical failures, limitations, device incompatibility, outdated application version, or external circumstances outside Eshe’s reasonable control;

  • user actions that violate these Terms, applicable law, third-party rights, or rules of third-party platforms.

If applicable law does not allow a complete exclusion or limitation of liability, Eshe’s liability is limited to the maximum extent permitted by such law.

This section does not limit Eshe’s liability for breach of mandatory obligations relating to personal data protection, security, consumer rights, or other mandatory obligations to the extent such liability cannot be excluded or limited under applicable law.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for intentional misconduct, gross negligence, fraud, harm to life or health, breach of mandatory consumer rights, or other cases where limitation of liability is not permitted.


36. User Responsibility for Violations and Third-Party Claims

The user is responsible for their use of Eshe, their account, User Content, actions in community / forum features, uploaded materials, payment actions, and compliance with these Terms.

To the extent permitted by applicable law, the user may be liable to Eshe for reasonable and documented losses, expenses, claims, demands, or other amounts that Eshe was required to incur as a result of:

  • the user’s violation of these Terms;

  • unlawful, bad-faith, or harmful use of Eshe;

  • publication, upload, or transmission of User Content that violates law, third-party rights, privacy, intellectual property rights, safety, or these Terms;

  • the user’s disclosure of personal data, health data, images, videos, voice, or other information of third parties without the proper right, permission, or legal basis;

  • impersonation of another person, specialist, partner, Eshe representative, or professional without the right to do so;

  • use of Eshe for unlawful medical, psychological, pharmaceutical, commercial, or other professional activity;

  • attempts at unauthorized access, scraping, reverse engineering, circumvention of restrictions, security violations, or interference with the operation of the service;

  • abuse of payments, promo codes, partner access, trial periods, complaints, support, or moderation mechanisms.

Eshe may require reasonable assistance from the user in defending against a third-party claim where such claim is related to the user’s actions, the user’s content, violation of third-party rights, or breach of these Terms.

This section applies only to the extent permitted by applicable law and does not limit the user’s mandatory consumer rights, where such rights apply.


37. Suspension, Restriction, and Termination of Access

Eshe may temporarily or permanently restrict, suspend, or terminate the user’s access to the account, certain features, paid capabilities, community / forum, AI features, uploads, partner scenarios, or the entire service if Eshe has reasonable grounds to believe that:

  • the user has violated these Terms;

  • the user has violated the law, third-party rights, or rules of a third-party platform;

  • the account is used for abuse, fraud, malicious activity, unlawful actions, or circumvention of restrictions;

  • the user publishes prohibited content, dangerous medical misinformation, threats, harassment, harmful materials, or unlawful offers;

  • the user attempts to gain unauthorized access to data, accounts, systems, APIs, infrastructure, or internal Eshe services;

  • the account has been compromised or there is a security risk;

  • payment is not confirmed, the subscription has expired, the payment has been refunded, disputed, or declared invalid;

  • access was provided through a program, promo code, partner access, grant-based, donor-funded, insurance, corporate, or third-party payer scenario that has ended, been cancelled, or no longer applies to the user;

  • such restriction is required by law, a public authority, court, platform, payment provider, partner, or security considerations;

  • continued access may create a risk to the user, other users, Eshe, data, infrastructure, partners, community space, or the company’s legal position.

Eshe may apply restrictions without prior notice if this is necessary for security, prevention of harm, protection of users, preservation of evidence, compliance with law, investigation of a violation, prevention of abuse, or protection of infrastructure.

Restriction or termination of access does not always mean an automatic refund, unless otherwise required by applicable law, the rules of the relevant platform, or the terms of the payment provider. Refund rules apply in accordance with the sections on payments and refunds, platform rules, and applicable law.

If the user’s account is restricted, suspended, or deleted, Eshe may retain certain data, records, or information to the extent necessary for compliance with law, security, investigation of violations, prevention of abuse, dispute resolution, backup recovery, or protection of legal position, in accordance with the Eshe Privacy Policy.

The user may stop using Eshe at any time by deleting the application, discontinuing use of the service, or, where such functionality is available, deleting the account. Stopping use of Eshe does not automatically cancel an active subscription purchased through a third-party payment channel if such cancellation must be performed separately.


38. Governing Law and Dispute Resolution

These Terms, their interpretation, and the contractual relationship between the user and FEM HEALTH LIFE LIMITED are governed by the laws of the Republic of Cyprus.

However, nothing in these Terms limits the user’s mandatory consumer rights, mandatory personal data protection rights, mandatory rights to contact competent authorities, courts, or regulators, or any other rights that cannot be excluded or limited under the applicable law of the user’s country.

The user may first contact Eshe using the contact details provided in these Terms in an attempt to resolve the matter directly. Eshe seeks to review inquiries in good faith and within a reasonable period, but does not guarantee that any dispute will be resolved in the user’s favor or without recourse to external protection mechanisms.

If a dispute cannot be resolved directly, it may be considered by a competent court or authority in accordance with applicable law, the user’s mandatory rights, and permissible jurisdiction rules.

Nothing in this section limits the user’s right to contact competent authorities regarding data protection, consumer protection, payment disputes, platform disputes, or other matters where such right is granted to the user by applicable law.


39. Changes to These Terms

Eshe may update these Terms from time to time where necessary due to:

  • changes in law;

  • product development;

  • changes to features, AI scenarios, community / forum, paid capabilities, or partner programs;

  • changes to payment, platform, or third-party services;

  • changes to the commercial model;

  • changes to security requirements;

  • the need to clarify, supplement, or improve the contractual framework for the use of Eshe.

If changes are material, Eshe may notify users through the application, website, email, in-app message, push notification, or another reasonable method, where such notice is required by law, platform rules, or the nature of the change.

For certain material changes, Eshe may request separate confirmation from the user where required by law, platform rules, the nature of the change, the terms of a paid feature, or Eshe’s internal rules.

Continued use of Eshe after the updated Terms come into effect may mean acceptance of the updated Terms, where permitted by applicable law. If the user does not agree with the updated Terms, the user must stop using Eshe and, where applicable, cancel any active subscription through the relevant payment channel.

The current version of the Terms is published in the application, on the website, or in another location where it is available to the user. The date of the last update may be indicated at the beginning of the document or in another clear manner.


40. Prevailing Language Version

Eshe may provide these Terms in several languages. Translations may be prepared for user convenience.

If there is any discrepancy between different language versions of these Terms, the version indicated by Eshe as the main version in the published document prevails, unless applicable law requires otherwise.

If Eshe does not specify another main version, the English version of these Terms prevails.

For matters related to personal data, privacy requests, data deletion, or the user’s rights regarding personal data, the user should contact Eshe in accordance with the Eshe Privacy Policy.

Eshe may request additional information necessary to verify the account, identity, payment, inquiry, complaint, or circumstances of a violation where such verification is necessary to protect the user, other users, data, the service, payments, community space, or Eshe’s legal position.
